Terms of Service
Effective date: 1 May 2025
These Terms of Service ("Terms") govern your access to and use of the Hey Neighbors platform, including all associated websites, applications, and services (collectively, the "Service"), operated by Hey Neighbors ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
The Service is intended for businesses, residential communities, and facility management organisations. You must be at least 18 years old and authorised to enter into contracts on behalf of your organisation to use the Service. By registering, you represent that these conditions are met.
2. Accounts and Workspaces
When you register, you create a workspace identified by a unique handle (e.g., yourcompany.heyneighbors.in). You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your workspace. Notify us immediately at admin@heyneighbors.in if you suspect unauthorised access.
You may not transfer your workspace to another party without our prior written consent.
3. Plans, Pricing, and Billing
3.1 Plans
We offer a free Starter plan and paid plans (Essentials, Complete, Professional) billed monthly or annually. Plan features and pricing are described on our Pricing page and may be updated with prior notice.
3.2 Pricing inclusive of GST
All prices displayed on the Service are inclusive of 18% Goods and Services Tax (GST) as applicable under Indian law. GST-compliant invoices are issued automatically upon each successful payment. If you provide a valid GSTIN, it will appear on your invoice.
3.3 Payment
Payments are processed by Razorpay. By providing payment details, you authorise us to charge the applicable fees on the billing cycle you select (monthly or annual). All charges are in Indian Rupees (INR) unless otherwise stated.
3.4 14-day free trial
New subscribers to paid plans receive a 14-day free trial. No payment is required during the trial. Billing begins automatically on day 15 unless you cancel or downgrade to the Starter plan before the trial expires. We will send a reminder 3 days before billing begins.
3.5 Annual billing
Annual subscriptions are billed upfront for 12 months and provide a discount equivalent to 2 months free. Annual subscriptions are not prorated for partial months.
4. Cancellation and Refunds
4.1 Cancellation
You may cancel your subscription at any time from your workspace settings. Cancellation takes effect at the end of the current billing period. Your workspace remains accessible until then, after which it downgrades to the Starter plan or is deactivated.
4.2 Refund policy
Monthly subscriptions: No refunds are issued for the current billing period after payment is processed.
Annual subscriptions: If you cancel within 7 days of your annual renewal date and have not made significant use of the Service during that period, you may request a prorated refund for unused months. Contact us at admin@heyneighbors.in with your workspace handle and reason for cancellation. Refund decisions are made at our sole discretion.
Trial cancellations: Cancelling before day 14 of the trial incurs no charge.
5. Acceptable Use
You agree not to:
- Use the Service to violate any applicable law or regulation.
- Attempt to gain unauthorised access to other workspaces or our systems.
- Upload or transmit malicious code, spam, or harmful content.
- Resell or sublicense the Service without our written consent.
- Reverse-engineer, decompile, or disassemble any part of the Service.
- Use the Service in any manner that could impair its availability or performance for other users.
We reserve the right to suspend or terminate accounts that violate these Terms with or without prior notice depending on the severity of the violation.
6. Your Data
You retain ownership of all data you upload to or generate within the Service ("Your Data"). By using the Service, you grant us a limited, non-exclusive licence to store, process, and display Your Data solely to provide and operate the Service.
We do not use Your Data to train machine learning models or share it with third parties except as described in our Privacy Policy.
7. Intellectual Property
The Service, including its software, design, trademarks, and content, is owned by Hey Neighbors and protected by applicable intellectual property laws. These Terms do not grant you any rights to our intellectual property other than the limited licence to use the Service as described herein.
8. Service Availability and SLA
We target 99.5% monthly uptime for paid plans. Planned maintenance is communicated at least 24 hours in advance where possible. We are not liable for downtime caused by circumstances beyond our reasonable control, including AWS outages, network failures, or force majeure events.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Hey Neighbors shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Hey Neighbors, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Any dispute arising under or in connection with these Terms shall first be attempted to be resolved amicably. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.
12. Changes to These Terms
We may modify these Terms from time to time. We will notify you of material changes by email or prominent notice on the Service at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
